As of September 2023, abortion is legal in most states in the US, but there are some states that have enacted bans or restrictions on abortion. According to the Guttmacher Institute, as of January 2023, 12 states are enforcing a near-total ban on abortion with very limited exceptions, including Alabama, Arkansas, and Idaho. In addition, four states have laws prohibiting abortion after a specific point in pregnancy, which would have been unconstitutional under Roe, are in effect. These bans limit people’s ability to obtain abortion care. Bans have been blocked in some states, including Arizona, North Dakota, Ohio, Utah, and Wyoming. However, it is important to note that the situation is rapidly changing, and laws and restrictions on abortion may vary by state. Planned Parenthood Action Fund provides an access tool to discover what states still allow abortion and which have adopted abortion restrictions. The Center for Reproductive Rights also provides a map of abortion laws by state.
