Under Republic Act No. 9165 (Comprehensive Dangerous Drugs Act of 2002), Section 91 specifically addresses the responsibility and liability of law enforcement agencies and other government officials and employees in testifying as prosecution witnesses in dangerous drugs cases. It mandates that any such person who, after due notice, intentionally or negligently fails or refuses to appear as a witness for the prosecution without valid reason shall face imprisonment of 12 years and 1 day to 20 years, plus a fine of ₱500,000, in addition to administrative liability imposed by their superior or appropriate body. Furthermore, the immediate superior who fails to exert reasonable effort to present the witness to court may face imprisonment of 2 months and 1 day to 6 years, a fine of ₱10,000 to ₱50,000, and perpetual absolute disqualification from public office. Also, the member of the law enforcement agency shall not be transferred or reassigned to any other unit without the approval of the court or the Department of Justice
